- INFORMATION WE COLLECT ABOUT YOU
We collect information about you so we can improve our Services and enhance your experience. Any of the below activities with regard to the collection of Website usage information may be performed on our behalf by our service providers, including, for example, our analytics vendors, if any, and our email management partners, if any. When analyzed, Website usage information helps us determine how visitors arrive at the Website, what type of content is most popular, and what type of visitors are interested in particular kinds of content and advertising.
While you may access some of the Krossover Services without registration, many of the content and Services available on the Website require registration. If you choose to register with our Website, we may require you to submit certain information personally identifying you, including your first and last name, title, home/business address, date of birth, jersey number, affiliated educational institution, affiliated sports team, e-mail address, username and password (collectively, “Personal Information”). “Personal Information” also includes “Personal Data” as that term is defined in Article 2 of the European Union Data Protection Directive.
Even if you do not register with Krossover, we collect information other than Personal Information, as detailed below (“Non-Personal Information”), about your use of our Website.
(a) Cookies and Other Technologies.
(b) Information Collected Automatically.
We automatically receive and collect information from or about the computers, phones, or other devices where you install or access our Services, depending on the permissions you’ve granted, such as IP address or other similar unique device identifier, the URLs of websites you arrive at the Website from or leave the Website to go to, your type of browser and language, access times, the content of any undeleted cookies that your browser previously accepted from us, your operating system, your mobile provider, your mobile device, and your ISP. We may use such information to better understand how Krossover users use our Services, to analyze trends, administer the Website, prevent fraud, and gather broad demographic information, such as country of origin. We may link this information with your Personal Information.
(c) Things you do and information you provide.
We collect the content and other information you provide when you use our Services, including when you sign up for an account, create, share, message or otherwise communicate with others. This can include information in or about the content you provide, such as the location of a photo or the date a video was created. We also collect information about how you use our Services, such as the content you view or engage with or the frequency and duration of your activities.
(d) Things others do and information they provide.
We collect content and information that other people provide or otherwise obtain when they use our Services, including information about you, such as when they share a video of you, send a message to you, or upload, sync or import information about you.
(e) Your networks and connections.
We collect information about the people and groups you are connected to or otherwise affiliated with and how you interact with them, such as the people you communicate with the most or the groups you like to share with. We also collect contact information you provide if you upload, sync or import this information from a device.

If you use our Services for purchases or financial transactions, we collect information about the purchase or transaction. This includes your payment information, such as your credit or debit card number and other card information, and other account and authentication information, as well as billing, shipping and contact details.

We collect information from and about the computers, phones, or other devices where you install or access our Services, depending on the permissions you’ve granted. We may associate the information we collect from your different devices, which helps us provide consistent Services across your devices.
(h) Information from websites and apps that use our Services.
We collect information when you visit or use third-party websites and apps that use our Services. This includes information about the websites and apps you visit, your use of our Services on those websites and apps, as well as information the developer or publisher of the app or website provides to you or us.
(i) Information from third-party partners.
We may receive information about you and your activities on and off the Website from third-party partners, such as information from a partner when we jointly offer services or from an advertiser about your experiences or interactions with them.
- KROSSOVER’S USE OF YOUR INFORMATION
We are passionate about creating engaging experiences for people. We use all of the information we have to help us provide and support our Services. Here’s how:
(a) Provide, improve and develop Services.
We are able to deliver our Services, personalize content, and make suggestions for you by using this information to understand how you use and interact with our Services and the people or things you are connected to and interested in on and off our Services.
We conduct surveys and research, test features in development, and analyze the information we have to evaluate, customize and improve products and Services, develop new products or features, and conduct audits and troubleshooting activities.
(b) Communicate with you.
We use your information to send you marketing communications, communicate with you about our Services, updates, promotional offers, and let you know about our policies and Terms. We also use your information to respond to you when you contact us, to provide customer support, and prevent potentially prohibited or illegal activities. You may opt out of certain communications by following the procedures set forth in Section 5 below.

We use the information we have to improve our advertising and measurement systems so we can show you relevant ads on and off our Services and measure the effectiveness and reach of ads and Services.
(d) Promote safety and security.
We use the information we have to help verify accounts and activity, and to promote safety and security on and off of our Services, such as by investigating suspicious activity or violations of our Terms or policies. We work hard to protect your account using teams of engineers, automated systems, and advanced technology such as encryption and machine learning.
The information we collect is stored on a secure, password-protected server and only authorized personnel have access to your information. Krossover uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage and related technology required to run the Website and Krossover owns the code, databases and all rights therein.
We use industry-standard encryption technologies with respect to the receipt and transfer of Personal Information you submit. Nevertheless, despite our best efforts, no transmission over the internet and no data storage method can be guaranteed to be safe 100% of the time. Krossover cannot guarantee that your end user data stored on our servers may not be accessed, disclosed, altered, or destroyed by breach of any of our industry standard physical, technical, or managerial safeguards. When you enter sensitive information (such as a credit card number) we encrypt such information using secure socket layer technology (SSL). The Krossover Website and software is hosted on servers in the United States. By using the Website, you consent to the transfer and storage of your information (including your Personal Information) in the United States and its use in accordance with the purposes for which it was originally collected.
Your password is the key to your account. We urge to you to use unique numbers, letters and special characters, and to keep your password secure. We recommend that you exit from your account at the end of each session, especially where you are accessing the Website on a public computer. Immediately notify Krossover of any unauthorized use of your password or account or any other breach of security. It is your sole responsibility to control the dissemination and use of your password, control access to and use of your account, and notify Krossover if/when you desire to cancel your account on this Website. We are not responsible or liable for any loss or damage arising from your failure to comply with this or any other provision.
Krossover will never request your password via email. If you receive an email or other correspondence requesting that you provide any sensitive information (including your Website password or credit card information) via email or to a Website that does not seem to be affiliated with our Website, or that otherwise seems suspicious to you, please do not provide such information, and report such request to us.
In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we will endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your email address, we may notify you by email. You consent to our use of email as a means of such notification.
(e) Create Krossover Content
We may use the information to create Krossover Content, which may include all or part of your Posted Content, and which may then be posted on any Krossover Website, social media page or on such third party sites for promotional, instructional or other editorial purposes as described in our Terms.
You specifically acknowledge that we have the right to publish all or part of your Posted Content (which may contain your Personal Information) to any Krossover Website or Krossover social media page or on such third party sites for such promotional, instructional or other editorial purposes as described in our Terms.
- DISCLOSURE OF YOUR INFORMATION
Krossover may disclose your Personal Information, Non-Personal Information and any and all analytics and other data Krossover produces from your Posted Content to recruiters, coaches, accredited colleges and universities that you have indicated you are interested in attending, as well as other accredited colleges and universities that Krossover and/or third party service providers that have entered into a business relationship with Krossover believe may be of interest to you.
We may also disclose aggregate statistics regarding user behavior as a measure of interest in, and use of, our Website in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user.
We reserve the right transfer information about you to another company in connection with a reorganization, merger, sale, acquisition or liquidation involving all or part of Krossover.
We reserve the right to disclose your Personal Information and other personally identifiable information as required by law or to comply with a judicial proceeding, court order, or other legal process. We may also disclose user information as necessary to enforce the Terms, in connection with investigations, or when we believe disclosure is necessarily incident to the provision of our Services or to the protection of the rights, property or safety of Krossover or others.
KROSSOVER SHALL HAVE NO LIABILITY FOR DISCLOSURE OF INFORMATION OBTAINED DUE TO ERRORS IN TRANSMISSION OR THE UNAUTHORIZED INTERVENTION OF THIRD PARTIES. FURTHER, IF YOU POST ANY OF YOUR PERSONAL INFORMATION IN PUBLIC AREAS OF THE WEBSITE, SUCH AS MESSAGE BOARDS, AND OTHER PUBLIC FORUMS, SUCH INFORMATION MAY BE COLLECTED AND USED BY OTHERS OVER WHOM WE HAVE NO CONTROL. WE ARE NOT RESPONSIBLE FOR THE USE MADE BY THIRD PARTIES OF INFORMATION YOU POST OR OTHERWISE MAKE AVAILABLE IN PUBLIC AREAS OF THE WEBSITE.
- DEACTIVATING ACCOUNT/OPT-OUT
Upon your request, or in the event we terminate your account in accordance with our Terms, we will deactivate your registered account within ten (10) days of Krossover’s receipt of such request. We may retain Personal Information, Posted Content and any other data produced by Krossover therefrom, from closed accounts to the extent necessary to comply with applicable law, prevent fraud, assist with any investigations, enforce our Terms, take actions we deem necessary to protect the integrity of the Website or our users, or as otherwise permitted by law.
You have the right to “opt in” and “opt out” of certain of our uses of your Personal Information and may change your preferences regarding such uses at any time. For example, we may use your email for transactional and promotional purposes. Emails we send you may contain code that enables our database to track your usage of the emails we send you, such usage includes whether the email was opened and what links (if any) were clicked. Krossover does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Website. The Website, including content available thereon, is not directed at children under the age of 13. In the event that we learn that we have collected Personal Information from a child under age 13 without parental consent, we will delete that information as quickly as possible.
- CALIFORNIA RESIDENTS
California Civil Code Section 1798.83 permits residents of the State of California to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. The notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it has been shared, along with their names and addresses.
